1. Operator and scope
Purplesse is operated by the legal entity identified in the Imprint. These General Terms apply to access to and use of the Story website, applications and related services.
Additional terms apply to Collectors, Creators, mature content, payments, payouts and specific platform features. Where special terms conflict with these General Terms, the special terms apply to that subject.
2. Platform purpose
Purplesse is a marketplace for curated visual stories. Creators may submit Stories, and Collectors may discover previews, purchase access and keep purchased stories in a private Collection.
Purplesse provides the technical marketplace and review workflow but does not guarantee that any submission will be accepted, published, purchased or continuously available.
3. Eligibility
Users must have the legal capacity required to enter into the relevant agreement. Users who do not have full legal capacity may use the platform only where permitted by applicable law and with any required consent.
Creator accounts, payout features and mature-content access are restricted to adults.
4. Accounts
Users must provide accurate and current information, keep login credentials confidential and prevent unauthorised use of their account.
Accounts may not be transferred, sold, shared commercially or created using false identities. Users are responsible for activity performed through their account unless they promptly report unauthorised access.
5. Marketplace transactions
Prices, taxes, currencies and applicable fees are displayed before a purchase or submission-related decision is completed.
Payments may be processed by an external payment provider. Additional payment, refund and payout conditions are described in the Collector Terms, Refund Policy and Payout Policy.
6. Platform content and user content
Purplesse owns or licenses the platform software, brand, interface, design system and platform-created content.
Creators retain their rights in Creator content but grant Purplesse the rights needed to host, process, review, display, market and deliver that content as described in the Creator Terms.
7. Acceptable use
Users must not use Purplesse for unlawful activity, fraud, harassment, impersonation, unauthorised scraping, access-control circumvention, account attacks, malware, stolen content or infringement of third-party rights.
Users must not copy, resell, redistribute, publicly repost or commercially exploit locked or purchased Stories unless expressly authorised.
8. Moderation and platform decisions
Purplesse may review submissions, investigate reports and restrict content or accounts where reasonably necessary to enforce platform rules, comply with law, protect users or prevent harm.
Where appropriate, Purplesse may provide a reason for a moderation decision and a method to request review or submit corrections.
9. Service availability
Purplesse aims to provide reliable access but does not guarantee uninterrupted or error-free operation. Maintenance, security incidents, provider outages and product changes may affect availability.
Features may be changed, replaced or discontinued. Purplesse will consider purchased access and mandatory consumer rights when making material service changes.
10. Third-party services
Purplesse may rely on external providers for authentication, hosting, storage, payments, payouts, email and other infrastructure.
Third-party services may be subject to their own terms and privacy information. Purplesse is not responsible for independent third-party services beyond the extent required by law.
11. Suspension and termination
Users may stop using Purplesse and may request account deletion subject to legal retention requirements.
Purplesse may restrict, suspend or terminate accounts for serious or repeated violations, fraud, security threats, unlawful activity, payment abuse or failure to meet verification requirements.
12. Liability
Purplesse remains liable where liability cannot legally be excluded, including for intentional misconduct, gross negligence, personal injury and mandatory consumer rights.
To the extent permitted by law, Purplesse is not liable for indirect losses, user-generated content, unauthorised third-party actions or failures caused by circumstances outside reasonable control.
13. Changes to the terms
Purplesse may update these terms where necessary for legal, security, technical or business reasons.
Material changes will be communicated in an appropriate manner. Mandatory rights and agreements already completed remain protected to the extent required by law.
14. Governing law and disputes
These terms are governed by Austrian law, without limiting mandatory consumer protections that apply in the user's country of residence.
Before starting formal proceedings, users are encouraged to contact Purplesse so that the issue can be reviewed and, where possible, resolved directly.
Questions about these terms or policies can be sent using the contact information in the Imprint.
